Teens in Rancho Penasquitos Park Rape Case Get 50+ Years in Prison

RANCHO BERNARDO, CA -- Two teenage boys who kidnapped and sexually assaulted two girls in a Rancho Penasquitos park were sentenced Thursday to 58- and 50-year- to-life prison terms.

Leonel Contreras, 18, was sentenced to the lengthier term. He and co- defendant William Steven Rodriguez, 17, were both 16 at the time of the Sept. 3, 2011, attack. They were tried as adults and convicted by separate juries last year.

Rodriguez was found guilty of 10 of 21 charges, including forcible oral copulation and forcible sodomy. Contreras was convicted on 21 counts, including conspiracy, rape and kidnapping and the use of a knife.

Deputy District Attorney Wendy Patrick told Judge Peter Deddeh that the defendants kidnapped the 15- and 16-year-old victims as they walked along a greenbelt behind a residential neighborhood about 8 p.m.

Patrick said the defendants took the girls -- who were both virgins -- to a secluded area and subjected them to multiple sex acts over 30 to 40 minutes.

"It was a prolonged, brutal sexual assault," the prosecutor said.

Deddeh said it was "awful and shocking" at how long the assault lasted.

"You robbed them (the victims) of their spirit," the judge told Rodriguez.

Deddeh chastised Contreras -- who he called the "shot caller" -- as being in denial and not owning up to what he did.

"It was brutal, callous and ruthless," Deddeh said of the attack, during which the defendants switched partners.

Deddeh said he would have given Contreras a more than 600-years-to-life sentence if he could have, but was precluded from doing so because Contreras was a juvenile at the time of the offense.

Patrick read a letter from the parents of Jane Doe 2, detailing the victim's struggles since the attack.

The defendants stole "something they had no right to take," the parents said in the letter.

Jane Doe 2 had constant nightmares but "has chosen not to live as a victim" and to "work toward healing," the letter read.

To the mothers of the defendants, the victim's parents said, "Our hearts break for you."

In her closing argument, Patrick told jurors the defendants had a plan to assault the girls and Contreras told Rodriguez that he had a knife.

But Rodriguez's attorney, Dana Feuling, said there was no conspiracy between the defendants and that her client acted on "impulse." She said Rodriguez cooperated after his arrest and admitted what he did.

Contreras' attorney, Michael Begovich, told the jury that police coerced a false confession from his client and prosecutors lacked evidence tying the defendant to the crime.

Patrick said the victims were friends who went to a family party in the 12600 block of Spindletop Road. Rodriguez and Contreras were out smoking marijuana when they spotted the two girls as they took a nighttime walk, the prosecutor said.

The boys accosted them, with Contreras holding a knife, and forced them to a more secluded area, using threats to make them stay quiet, she said.

According to the prosecutor, the defendants subjected them to "a brutal 30- to 40-minute series of sexual assaults that included every imaginable kind of rape."

Patrick said graffiti found in the open space resulted in a tip that led investigators to Rodriguez, who told police what happened. Police then tracked down Contreras.

There's a big difference there, you can't compare the two, one is brutal rape and the other is a person of authority having sex with a student.

How many stories have you heard of where teenagers commit crimes and get a slap on the wrist to latter up the ante, you can't call brutal rape a stupid thing young people do, I hope to never know any young or old people who would brutally rape and life while the victim's are begging !

I say charge EVERYONE based on the crime regardless of their age. We are raising a whole generation of sick, twisted little bastards, so just execute them all for committing rape, murder, child molestation, animal abuse, etc. They "people" have no and will NEVER have any redeeming value so let's start thinning the heard!

The death penalty is hardly barbaric and you seem to feel for the criminals and NOT the victims OR the taxpayer. Jail is a waste of money - let's rid the country of all these sociopaths and USE THE DEATH PENALTY. One year from their sentence, we eliminate them.

They are probably being raised by a single mother who has with multiple children with multiple fathers, no high school diploma, no job or a low-paying one and are on some type of social program. I am NOT saying all single mothers are crappy mothers What I AM saying is that is you look at the backgrounds of the scumbags who commit these heinous acts these are the things that keep popping up over and over. And NO father around is a BIG red flag!

In comparision- this was perfect. Those who get lesser punishment for murder and other forms of torture- their judges were to lenient.

I wholeheartedly AGREE w/June Goodsell! If thru DNA you are proven to be the perpetrator, immediate castration. It will not end the actions of these violent predators, however, if one knows that is the punishment, no stays, no appeals, no nonsense, perhaps it just may cause one of these violent predators to think twice. Our laws were written a long time ago, as was our constitution, and no one could have ever imagined the heinous crimes that would come to be. No one handles things with their fists anymore, if a young man wants sex, he takes it, if someone wants your car, they take it, and so on. Perhaps time to update the law to fit the crimes we are seeing in today's world. When the young girl (Polly Klaas?) was taken from her bedroom/sleepover, raped and killed, what law protected her? I feel her perp deserves to feel the same terror and pain he inflicted.

I know people who are from certain Middle Eastern countries and the man is beheaded or his penis is cut off in public. I once saw a video of this on Youtube. Of course it was immediately removed as the rest of the world is not supposed to know this thanks to our censorship process. The Middle Eastern people I know did not tell me that the children and women were. In our so called "free world," in many courts in the past before DNA evidense was permitted, and presently in churches, it is also demanded to have 2 to 3 witnesses. Many of our "Christian" church goers here see DNA evidense as witchcraft. Good example of under educated American junk values: the jurors in the O.J. Simpson trial.

one needs to be aware -- whether they have a penis or not -- sexual assault/rape is a crime of power and control over another person -- (many rapists are actually impotent in their relationships with people their own ages)

I see way to many bleeding harts for these two scum-bags. This wasn't taging a wall or some act of vandalism or property theft... these were the acts of a "predator" and this sort of behavior does not change, regardless of age. They are dangerous now and will be dangerous in the future. The best for all concerned (especially the public) would be to have simply put an end to them. The world would be a better (and safer) place without them in it. I'd feel sorry for them but I, for one, would have had no problem in pulling the lever that would have sent them to meet their maker.
